The NSAA Board of Directors met on September 14, 2023 at the NSAA Office in Lincoln with members present as follows:

District I - Kara Graham, Lincoln Southeast​
District I - Dr. Dana Wiseman, Sutton​
District II - Dr. Nick Wemhoff, Fort Calhoun​
District II - Thomas Lee, Omaha Westview​
District III - Dr. Jon Cerny, Bancroft-Rosalie​
District IV - Darren Tobey, Broken Bow​
District V - Randy Geier, Wauneta-Palisade (Alternate)​
District VI - Dr. Troy Unzicker, Alliance​
Also in attendance: Dr. Zainab Rida, Nebraska Department of Education Liaison; Bobby Truhe, NSAA Legal Counsel; Luke Post, HBE CPA; Krystal Siebrandt, HBE CPA.

The meeting was called to order at 8:30 a.m.

1. Motion was made to approve the Consent Agenda. Items on the Consent Agenda included:
  • Approval of the Agenda as presented
  • Approval of the Minutes of the August 3, 2023 Girls Wrestling Committee meeting
  • Approval of the Financial Statements

  • Approval of the following new cooperative sponsorships for the 2023-24 and 2024-25 school years:
    • Wayne and Laurel-Concord-Coleridge for Wrestling and Girls Wrestling
    • Guardian Angels Central Catholic and West Point-Beemer for Baseball
    • Ainsworth, Rock County and Keya Paha for Girls Wrestling
    • Columbus and Columbus Lakeview for Boys Swimming and Girls Swimming
    • Omaha Concordia and Omaha Street School for Wrestling
    • Omaha Brownell-Talbot, Omaha Concordia, Omaha Roncalli and Cornerstone Christian for Boys Swimming
  • Approval of the following cooperative sponsorship renewals for the 2024-25 and 2025-26 school years:
    • Thedford and Sandhills for Football, Volleyball, Boys Cross Country, Girls Cross Country, Wrestling, Girls Wrestling, Boys Basketball, Girls Basketball, Boys Track, Girls Track and Boys Golf
    • Arcadia and Loup City for Football, Volleyball, Boys Cross Country, Girls Cross Country, Girls Golf, Wrestling, Girls Wresting, Boys Basketball, Girls Basketball, Boys Track, Girls Track and Boys Golf
  • Approval of the dissolution of the following cooperative sponsorships for the 2023-24 school year:
    • Humboldt-Table Rock-Steinauer and Pawnee City for Wrestling and Girls Wrestling

2. Moved to appoint KSB Law as the NSAA Legal Counsel for the 2023-24 school year. Motion Carried: 8-0

3. Moved that the Board will submit a legislative proposal in each of their districts to amend Constitution and Bylaw Section 2.7. Motion Carried: 8-0

4. Moved that the Board will submit a legislative proposal in each of their districts to amend Constitution and Bylaw Section 1.5. Motion Carried: 7-1 (For: Graham, Wiseman, Wemhoff, Lee, Tobey, Geier, Unzicker | Against: Cerny)

5. The Board entered closed session at 9:05 a.m. to hear an appeal from Kearney Catholic.

6. The Board exited closed session at 9:14 a.m.

7. The Board heard a request from Cody-Kilgore for a wavier of Approved Ruling 3.11.1 - 3.11.13.

8. It was moved to approve December 23 through December 27 as the moratorium dates for the 2026-27 school year. Motion Carried: 8-0

9. Moved to approve the 2023-24 NSAA Budget. Motion Carried: 8-0

10. Moved to approve the 2023-24 Play Production Manual and 2023-24 Speech Manual. Motion Carried: 8-0

11. Moved to approve the Girls Wrestling Sub-District format, Girls Wrestling District Finals qualification process and Girls Wrestling District Finals and Boys Wrestling District dates. Motion Carried: 8-0

12. Moved to allow the use of the shot clock in Boys Basketball and Girls Basketball in Classes C1, C2, D1 and D2 based on a game-by-game or tournament-by-tournament trial if all schools agree and the NSAA Staff is notified prior to the contest(s). Motion Carried: 7-1 (For: Graham, Wiseman, Wemhoff, Lee, Cerny, Tobey, Unzicker | Against: Geier)

13. Moved to approve the salaries of Interim Associate Director Jeff Johnson and Assistant Director Colton Wierzbicki. Motion Carried: 8-0

14. Moved to enter into executive session at 11:52 a.m. to review the appeal of a hardship from Kearney Catholic, to update the 2023-24 Board of Directors Policy Manual, to review the waiver request from Cody-Kilgore, discuss comparable sport participation, review the Executive Director job description and evaluation instrument and to receive legal advice and protect confidentiality, which protects the reputation of affected individuals and is in the public interest. Motion Carried: 8-0

15. It was moved to exit executive session at 2:15 p.m. Motion Carried: 7-0 (Absent: Unzicker)

16. Moved that the eligibility of the Kearney Catholic student shall be based on the domicile of the biological mother. Motion Carried: 6-0 (For: Graham, Wiseman, Wemhoff, Lee, Cerny, Geier | Abstain: Tobey | Absent: Unzicker)

17. Moved to approve updated language to Section III (Regular & Special Board Meetings) of the 2023-24 Board of Directors Policy Manual. Motion Carried: 7-0 (Absent: Unzicker)

18. Moved to grant Cody-Kilgore's request for a waiver of Approved Ruling 3.11.1 - 3.11.13, allowing the junior high volleyball team to practice in the same gym at the same time as the high school volleyball team. Motion Carried: 7-0 (Absent: Unzicker)

There being no further business, the meeting was adjourned at 2:21 p.m.

The next meeting of the NSAA Board of Directors will be October 5, 2023 at the NSAA Office in Lincoln.
