The NSAA Board of Directors met September 18, 2014 at the Association Office in Lincoln with the following members present:

District I - Mark Norvell, Fillmore Central
District I - Wendy Henrichs, Lincoln East
District II - Dr. Bob Reznicek, Boys Town
District II - Nolan Beyer, Millard Public Schools
District III - Jay Bellar, Battle Creek
District IV - Dr. Brian Maher, Kearney
District V - Alan Garey, Medicine Valley
District VI - Troy Unzicker, Alliance

Also in attendance were: Rick Moses, Nebraska Dept. of Education liaison; Rex Schultze, NSAA legal counsel; Dick Beechner, Nebraska Hall of Fame; Larry Munksgaard, Nebraska Hall of Fame; Joe Tynon, Activities Director, Lourdes Central Catholic High School; Marco Fabietti, student; Brad and Joe Vasa, host parents; Cindy Wendell, Superintendent, Sumner-Eddyville-Miller schools; and Bill Schmidt, Activities Director, Sumner-Eddyville-Miller.

The meeting was called to order at 8:00 a.m.

1. Moved to approve the Consent Agenda as presented. Items included the Minutes of the August 13, 2014 Regular Board of Directors Meeting; approval of the August 28, 2014 Telephonic Board of Directors Hearing; approval of financial statements; approval of new cooperative sponsorships for Norfolk, Wisner-Pilger, Norfolk Catholic and Lutheran High Northeast High Schools for girls swimming; Emerson-Hubbard and Pender High Schools for speech; and approval of cooperative sponsorship renewals for Schuyler, Clarkson and Leigh High Schools for wrestling; O'Neill and St. Mary's High Schools for boys golf; Norfolk, Norfolk Catholic and Lutheran High Northeast High Schools for boys swimming. Motion Carried: 8-0

2. Moved to approve the 2014-15 Budget. Motion Carried: 8-0

3. Moved to approve the Board of Directors Policy Manual. Motion Carried: 8-0

4. Moved to approve December 23-27, 2016 as the December Moratorium dates for the 2016-17 school year. Motion Carried: 8-0

5. Moved to give the NSAA staff authority to negotiate a site for the Class B State Tennis Championships. Motion Carried: 8-0

6. Board discussed potential proposals to be considered at district meetings.

7. Moved to waive the hearing officer procedures under Bylaw 1.10.2.10 at the request of Sumner-Eddyville-Miller and proceed directly to an appeal before the Board of Directors under Bylaw 1.10.2.15. Motion Carried: 8-0

8. Lourdes Central Catholic High School appeared before the Board to appeal a denied International Transfer/Visa program change hardship for Marco Fabietti. Following a presentation of the evidence, those representing the student provided clarifying information and answers to Board members' questions.

9. Sumner-Eddyville-Miller High School appeared before the Board to appeal the forfeiture penalty imposed by the Executive Director for use of an ineligible international student. Following a presentation of evidence, those representing the student provided clarifying information and answers to Board members' questions.

10. It was moved to enter Executive Session at 12:05 p.m. to deliberate hearings and personnel matters. Motion Carried: 8-0

11. The Board exited Executive Session at 1:10 p.m.

12. In open session, the Board further addressed the hardship ruling for Marco Fabietti. It was moved to adopt findings of fact and determination to uphold the Executive Director's ruling. Motion Carried: 8-0

13. In open session, the Board further addressed the forfeiture penalty for Sumner-Eddyville-Miller. It was moved to overturn the Executive Director's ruling for Sumner-Eddyville-Miller and determined that a reprimand be issued to Sumner-Eddyville-Miller and that the Activities Director be required to attend the 2015 NSAA Activities Director's Out-of-the-Blocks Workshop. Sumner-Eddyville-Miller must also provide a plan of corrective action to the NSAA Executive Director no later than October 1, 2014. Motion Carried: 8-0

There being no further business, the meeting adjourned at 1:15 p.m.

The next meeting of the Board of Directors will be held in Lincoln on Thursday, October 9, 2014.
